What Information We Collect

When you interact with Dow online or in response to Dow’s marketing communications, Dow collects “Personal Data” about you, by which we mean information that may identify you personally, either alone or in combination with other information available to Dow. Information You Provide.

Information Sent to Us by Your Web Browser.

Analytics.

• Dow uses web analytics services including Adobe Experience Cloud products provided by Adobe Systems Incorporated (“Adobe”), and Google Analytics provided by Google, Inc. (“Google”).

The information generated by the cookies about your use of the website (including your IP address) will be transmitted to and stored by Adobe and Google on servers in: the United States (Adobe); and the U.S. and other countries (Google).
• Adobe and Google will use this information to provide data about your use of the website that allow creation of reports on website activity for website operators, and providing other services relating to website activity and internet usage.

• Dow uses Qualtrics -- a third-party survey provider -- to solicit and gather qualitative user opinions of its websites. Filling out a survey is never a requirement to view a Dow website and is at the sole discretion of the user. Any data provided is transmitted to and stored by Qualtrics on servers in the United States.
• Dow employs other peripheral technologies that complement dow.com, but are not a part of it. Examples include Oracle Eloqua – a marketing automation platform that deploys email campaigns and hosts related landing pages – and QUMU – an enterprise video platform that hosts and distributes live and on-demand video content. Both systems similarly follow the tracking standards enumerated for other technologies above.

Ad Remarketing.

• This website uses remarketing services such as Google AdWords, Facebook/Instagram, LinkedIn, DoubleClick, AddThis and others to advertise on third-party websites (including Google) to previous visitors to our site.
• These remarketing services can be used in different ways, including:
  • Advertising to previous visitors who haven’t completed a task on our site, for example using the contact form to make an enquiry or to previous visitors who have viewed information on our products.
  • Displaying an advertisement on the Google search results page, a site in the Google Display Network, or on a social network.

Additional Information for EU-based Users

Legal Basis for Processing.
European Personal Data may only be processed by Dow where and to the extent that such processing is:

• Necessary for the performance of a contract with you, such as:
  • To carry out Dow’s obligations with respect to any contractual agreements between us with respect to information, products, and services that you may request from Dow;
  • To process a job application; or
  • To fulfill any other agreements between us.
• Necessary for Dow to comply with a legal obligation, for example to meet our tax and accounting obligations.
• Necessary to serve the legitimate business interests of Dow or a third party, where such use is consistent with the fundamental rights of individuals under European law, for example:
  • To provide you with effective customer service or technical support, such as where you have requested information from Dow;
  • To contact you with information regarding health and safety, applicable regulations, or stewardship of our products;
  • To improve the content, functionality, performance, security and usability of our website;

  • To conduct business transactions, including purchases and sales of Dow products, or business reorganizations including the sale, transfer, change in control or merger of Dow assets or businesses.

Data Subject Rights.
European users of this website have the legal right to request Dow undertake specific actions with respect to their Personal Data, including:

• The right to request access to your Personal Data, including the right to have Dow confirm if your Personal Data is being used by Dow;
• The right to have your Personal Data corrected or erased;
• The right to object to or restrict Dow’s use of your Personal Data, for example where such information is not accurate or no longer needed;

Cross-Border Transfers of Data.
The information that Dow collects from you will be transferred to, and stored at, a destination outside the European Economic Area (“EEA”). It may be processed by staff operating outside the EEA who work for us, or by other entities acting as data processors on our behalf. Dow has implemented international data transfer agreements on the basis of the European Commission’s Standard Contractual Clauses in order to provide appropriate and suitable safeguards for the transfer of this information. Data Retention.
Dow will process and store your Personal Data for the duration of our relationship with you, which may be a long term, and as long as necessary to fulfill our contractual and legal obligations. Dow will delete your data:

• When it is no longer necessary for the purposes for which that information was collected and processed;
• Upon your request or objection, provided there are no overriding legal grounds requiring Dow to maintain that information;
• When necessary to comply with Dow’s legal obligations; and
• If our collection of information was based on your consent, upon the withdrawal of your consent.

Additional Information for California Residents

The California Consumer Privacy Act of 2018 (the “CCPA”) requires Dow to disclose certain additional information to California residents. This Section provides such additional information applicable to visitors, users and others who reside in the State of California, which may not apply to users in other geographies.

Information We Collect.
Our website collects information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household (“Personal Information”). In particular, our website has collected the following categories of personal information from its consumers within the last twelve (12) months:

Personal Information does not include:

• Information excluded from the CCPA's scope, like:

How We Collect Information About You.
We obtain the categories of Personal Information listed above either directly from you (e.g., from forms you complete or products and services you purchase) or indirectly from you (e.g., from observing your actions on our website).

Use of Personal Information.
We may use the Personal Information we collect for any legitimate and lawful business purpose, including those listed in the Section below titled “How Dow May Use and Share Your Information.”

Sharing Personal Information.
We may share your Personal Information as described in the Section below titled “How Dow May Use and Share Your Information.”

Disclosures of Personal Information for a Business Purpose.
In the preceding twelve (12) months, Dow has disclosed the following categories of Personal Information for a business purpose:

Sales of Personal Information.
In the preceding twelve (12) months, Dow has not sold any Personal Information.

Your Rights and Choices.
The CCPA provides California residents with specific rights regarding their personal information. The following describes your CCPA rights and explains how to exercise those rights.

Access to Specific Information and Data Portability Rights.
You have the right to request that we disclose certain information to you about our collection and use of your Personal Information over the past twelve (12) months. Once we receive and confirm your verifiable consumer request (see Exercising Access, Data Portability, and Deletion Rights), we will disclose to you:

• The categories of personal information we collected about you.
• The categories of sources for the personal information we collected about you.
• Our business or commercial purpose for collecting or selling that personal information.
• The categories of third parties with whom we share that personal information.
• The specific pieces of personal information we collected about you (also called a data portability request).
• If we sold or disclosed your personal information for a business purpose, two separate lists disclosing:
  • sales, identifying the personal information categories that each category of recipient purchased; and
  • disclosures for a business purpose, identifying the personal information categories that each category of recipient obtained.

Deletion Request Rights.
You have the right to request that Dow delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request (see Exercising Access, Data Portability, and Deletion Rights), we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.

We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

• Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.
• Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
• Debug products to identify and repair errors that impair existing intended functionality.
• Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
• Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).
• Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information's deletion may likely render impossible or seriously impair the research's achievement, if you previously provided informed consent.
• Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
• Comply with a legal obligation.
• Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

Exercising Access, Data Portability, and Deletion Rights.
To exercise the access, data portability, and deletion rights described above, please submit a verifiable consumer request to us by either:

• Filling out this online form.

Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.

You may only make a verifiable consumer request for access or data portability twice within a twelve (12) month period. The verifiable consumer request must:

• Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.
• Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. Making a verifiable consumer request does not require you to create an account with us. We will only use personal information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request.

Response Timing and Format.
We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing. If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option. Any disclosures we provide will only cover the twelve (12) month period preceding the verifiable consumer request's receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance. We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Non-Discrimination.
We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:

• Deny you goods or services.
• Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
• Provide you a different level or quality of goods or services.
• Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

How Dow May Use and Share Your Information

Subject to applicable local law, Dow may use the personal information we collect through our website for any legitimate and lawful business purpose, including but not limited to the following:

Children's Privacy

Dow’s website is not intended for children under 16 years of age, and Dow does not knowingly collect information from children to sell or promote our products or services. No one under the age of 16 may provide information to Dow on or through our website, and if we learn that we have received information from a child under the age of 16, we will delete that information.

Dow may host educational programs in science for students and teachers in our communities, but we do not invite minors to contact us or provide us with personal information. Visitors must be 18 years of age or older to submit registration or survey information. Parents or legal guardians may register to obtain information or participate in a survey on behalf of their children.
